Terms of Service

Effective Date: October 8, 2026 • Last Revised: October 8, 2026

Please read these terms carefully. They establish our mutual obligations, detail our candidate-first 30-day non-recurring passes, set out our AI accuracy disclaimers, and define the fair use guidelines that protect all candidates on the WorkScout platform.

Executive Summary & Candidate Protections

At WorkScout, we believe job seekers deserve dignity, speed, and absolute clarity. Unlike standard industry services, we never enroll you into covert auto-renewing subscriptions—all paid upgrades are explicit 30-day non-recurring passes. You own 100% of your career data and tailored resumes. In exchange, you agree to use our AI and infrastructure ethically, without botting, account sharing, or programmatic abuse.

01

Agreement to Terms & Eligibility

These Terms of Service (“Terms”, “Agreement”) constitute a legally binding agreement between you (“User”, “Candidate”, “you”, or “your”) and WorkScout (together with its parent operators, affiliates, successors, and assigns, “WorkScout”, “we”, “us”, or “our”), concerning your access to and use of the WorkScout website located at myworkscout.com, our web applications, our Google Chrome browser extension, and any associated application programming interfaces (collectively, the “Services”).

By accessing, browsing, registering for, installing, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by all of these Terms of Service. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND MUST CEASE USAGE IMMEDIATELY.

The Services are intended solely for individuals who are at least eighteen (18) years of age and legally capable of forming a binding contract under applicable law. Individuals under the age of 18 are not permitted to register for or use the Services. If you access or use the Services on behalf of any entity or organization, you represent and warrant that you possess full legal authority to bind that entity to these Terms.

02

  • Companion Chrome Extension: Automated one-click capture of job postings and company data from major public employment boards into your WorkScout CRM pipeline.
03

Intellectual Property Rights & Proprietary Platform Assets

Unless otherwise explicitly indicated in writing, the Services—including all source code, databases, backend microservices, algorithmic pipelines, system prompts, prompt engineering designs, user interfaces, frontend architecture, visual designs, audio/video telemetry engines, text, graphics, logos, trademarks, and service marks (collectively, the “WorkScout Intellectual Property”)—are owned, controlled, or licensed by WorkScout, and are protected by United States and international copyright, trademark, patent, trade secret, and unfair competition laws.

Except as expressly provided in these Terms, no part of the Services or WorkScout Intellectual Property may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever without our express prior written permission.

Subject to your complete and ongoing compliance with these Terms and your active access pass, WorkScout grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services solely for your personal, non-commercial employment seeking activities.

04

User Content & Candidate Ownership Guarantee

Candidate Data Pledge: You retain 100% full legal ownership, copyright, and title to your resumes, job history, career achievements, cover letters, and personal notes uploaded to WorkScout.

You are solely responsible for all content, career materials, documents, audio clips, video recordings, profile pictures, and messages that you upload, transmit, or store on the Services (“User Content”). WorkScout does not claim any ownership rights over your User Content.

By submitting User Content to the Services, you grant WorkScout a worldwide, non-exclusive, royalty-free, limited license to host, process, store, parse, index, format, and display such content solely and strictly for the purpose of operating, maintaining, securing, and providing the Services to you (including running vector similarity searches and passing your prompt context to secure underlying AI language models).

Zero Public Sale of Candidate Data: WorkScout will never sell, rent, commercialize, or publicly distribute your personal resume data, application pipeline, or career records to third-party data brokers, marketers, or advertisers.

05

User Representations & Account Registration

By creating an account and using the Services, you represent, warrant, and covenant that:

  • All registration information you submit via Clerk authentication (or email/social providers) is truthful, accurate, current, and complete.
  • You will maintain the accuracy of such information and promptly update it as necessary.
  • You have the legal capacity to enter into and abide by these Terms.
  • You will not access the Services through automated or non-human means, whether through a bot, crawler, script, scraping tool, or automated browser process, except for our official Chrome extension.
  • You will not use the Services for any illegal, unauthorized, fraudulent, or abusive purpose.
  • Your use of the Services will not violate any applicable local, state, national, or international law, regulation, or third-party right.

You are solely responsible for maintaining the confidentiality of your account credentials, tokens, and active sessions. You agree to immediately notify WorkScout of any unauthorized access, breach, or compromise of your account. WorkScout cannot and will not be liable for any loss or damage arising from your failure to safeguard your account.

06

Prohibited Uses & System Integrity

You may not access or use the Services for any purpose other than that for which we make the Services available. As an express condition of your use, you agree that you will NOT under any circumstances:

Automated Scraping & Botting

Systematically retrieve data, job records, or AI outputs to compile a database, directory, or commercial corpus through spiders, robots, or automated scrapers.

Reverse Engineering & Extraction

Decompile, reverse engineer, disassemble, decipher, or extract proprietary system prompts, scoring algorithms, or backend API source code.

Commercial Reselling & Agency Sharing

Sell, lease, rent, sublicense, or share an individual candidate access pass with multiple job seekers or operate as an unlicensed resume tailoring agency.

Security & Quota Circumvention

Bypass, disable, or tamper with security features, rate-limiting headers, Redis token buckets, or authentication checks.

Additionally, you shall not upload defamatory, obscene, harassing, fraudulent, or legally infringing material; distribute malicious code or viruses; or probe, scan, or test the vulnerability of WorkScout infrastructure without prior explicit written authorization.

07

Flat-Rate Access Passes, Billing & Refund Policy

Zero Auto-Renew Trap Guarantee: All paid tiers on WorkScout are non-recurring 90-day access passes. We will NEVER sneakily charge your card month after month.

WorkScout delivers transparent, candidate-centric billing. Our pricing model operates on fixed 90-day non-recurring access passes (“Access Passes”) rather than open-ended auto-billing subscription traps or stressful micro-metered token fees:

  • Pass Duration & Expiration: When you purchase a Plus Career Pass (\$30) or Professional Suite Pass (\$60), you receive full tier access for exactly ninety (90) consecutive calendar days from the moment of transaction completion. At the conclusion of your 90-day term, your account gracefully transitions back to the Free Candidate Tier. No recurring automatic debits will occur without your manual repurchase.
  • Payment Processors & Security: All transactions are processed through PCI-DSS Level 1 certified third-party payment gateways (e.g., Stripe). WorkScout does not store, retain, or have access to your full credit card numbers or banking secrets.
  • Price Modifications: WorkScout reserves the right to revise pass pricing for future purchases at any time. Any price updates will be reflected on the Pricing Page and will not retroactively alter an active, paid 90-day pass.
  • Refund Policy: Because WorkScout immediately provisions computational infrastructure, vector embedding indexes, and third-party AI tokens upon activation, Access Passes are non-refundable once substantial AI services (such as targeted resume tailoring, cover letter generation, or mock video interviews) have been consumed. If you experience technical defects preventing service utilization, you may submit a refund request to [email protected] within seven (7) days of purchase.
08

Fair Use Policy (FUP) & Anti-Abuse Burst Limits

To ensure low latency, platform stability, and high performance for the entire candidate community, all Access Passes are subject to our Fair Use Policy. Allowances are generously scaled to accommodate active human job seekers during intensive search campaigns:

Tier / Plan90-Day Tailor & Cover QuotaVideo Studio Mock InterviewsSalary & ATS Analytics
Free Candidate5 Resumes / 30 Days1 Preview SessionStandard Scoring
Plus Career (\$30)150 Resumes & Cover Letters / 90 DaysAudio STAR Practice30 Counter-Offer Scenarios
Professional Suite (\$60)450 Resumes & Cover Letters / 90 Days90 High-Fidelity Video SessionsUnlimited Deep Diagnostics

Burst Velocity Limits: WorkScout employs rate-limiting filters (e.g., maximum tailoring requests allowed per 10-minute sliding window) to prevent script-driven denial-of-service surges. Accounts that repeatedly trigger burst throttles or exhibit automated, non-human usage patterns may be temporarily throttled or suspended pending manual review.

09

AI Recommendations, Output Accuracy & Hallucination Disclaimer

Mandatory Candidate Review: Generative artificial intelligence may produce inaccurate or embellished assertions. You are solely responsible for reviewing and verifying all generated content prior to submitting applications.

WorkScout integrates state-of-the-art large language models (such as Google Gemini Pro and Flash) to assist in parsing job descriptions, extracting keywords, and recommending resume bullet points. You expressly understand and agree that:

  • No Employment or Interview Guarantees: WorkScout does not represent, warrant, or guarantee that using our tailored resumes, cover letters, or interview simulations will result in interview invitations, hiring offers, compensation increases, or favorable recruiter evaluations.
  • Factual Accuracy Responsibility: You remain solely and legally responsible for ensuring that all statements, dates, credentials, certifications, technical proficiencies, and employment histories reflected in your finalized resumes are truthful and non-deceptive. Submitting unverified or exaggerated claims to prospective employers is done at your sole risk.
  • Evolving AI Technologies: Outputs generated by artificial intelligence are probabilistic in nature. WorkScout does not guarantee that tailored outputs will be free from syntactic errors, occasional hallucinations, or regional linguistic nuances.
10

Video Studio Mock Interviews & Telemetry Disclaimer

The WorkScout Video Studio utilizes client-side browser APIs (WebRTC, MediaStream) to provide real-time interview feedback. By granting your browser permission to access your webcam and microphone, you acknowledge and agree that:

  • No Biometric Surveillance or Facial Recognition: WorkScout does NOT create, store, or sell biometric faceprints, facial recognition identifiers, or voiceprint templates. Posture indicators (such as center framing and head tilt) and delivery metrics (such as vocal cadence and filler words) are processed transiently in your local browser runtime.
  • Speech Transcription: Audio responses provided during simulated mock interviews are converted to text using secure transcription services solely to grade your response against the STAR (Situation, Task, Action, Result) interview methodology.
  • Local Recording Retention: Mock interview video feeds remain in your local browser session cache unless you explicitly choose to export or download a recording file to your personal device.
11

Companion Chrome Extension & Third-Party Platforms

The WorkScout Chrome Extension allows candidates to seamlessly bookmark job postings from external websites (such as LinkedIn, Indeed, Glassdoor, Greenhouse, Lever, and corporate career portals).

WorkScout is an independent platform and is not endorsed by, sponsored by, or affiliated with LinkedIn, Indeed, or any third-party job board. You are responsible for ensuring your personal use of browser extensions complies with the respective terms of service of third-party websites you visit.

WorkScout exercises no control over, and assumes no liability for, the content, accuracy, hiring policies, privacy practices, or availability of external third-party employment listings or recruiter contact profiles.

12

Salary & Career Advisory Disclaimer

All compensation ranges, counter-offer talking points, equity estimations, and negotiation scripts provided by WorkScout are for educational, informational, and preparation purposes only. WorkScout does not provide formal legal, financial, tax, or accredited career counseling advice.

Labor market conditions, executive equity packages, and benefits structures vary significantly based on geographic location, employer size, and candidate qualifications. You should consult certified financial or legal counsel regarding complex employment contracts, equity grants, non-competes, and severance packages.

13

Privacy Policy & Data Security

15

WorkScout reserves the right to change, modify, update, suspend, or discontinue all or part of the Services at any time without notice. While we strive for continuous 99.9% platform availability, we cannot guarantee that the Services will be uninterrupted or error-free at all times.

You agree that WorkScout has no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Services during any downtime, scheduled maintenance, network disruption, or discontinuance of the Services.

16

These Terms shall remain in full force and effect while you use the Services or maintain an account on WorkScout.

WITHOUT LIMITING ANY OTHER PROVISION OF THESE TERMS, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SERVICES (INCLUDING BLOCKING CERTAIN IP ADDRESSES) TO ANY PERSON FOR ANY REASON OR FOR NO REASON, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT CONTAINED IN THESE TERMS OR OF ANY APPLICABLE LAW OR REGULATION.

If we terminate or suspend your account for breach of these Terms, you are strictly prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party.

17

Certain state laws (including in California and New Jersey) do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers or limitations may not apply, and you may have additional rights.

19

Indemnification

You agree to defend, indemnify, and hold harmless WorkScout, our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of:

  • Your User Content uploaded to or generated by the platform;
  • Your use or misuse of the Services;
  • Your breach of these Terms of Service or any representation or warranty made herein;
  • Your violation of the rights of a third party, including intellectual property or privacy rights; or
  • Any overt harmful act toward any other user of the Services with whom you connected via the Services.
20

Mandatory 60-Day Informal Dispute Resolution

To expedite resolution and control the cost of any dispute, controversy, or claim related to these Terms (“Dispute”), you and WorkScout agree to first attempt to negotiate any Dispute (except those Disputes expressly excluded below) informally for at least sixty (60) days before initiating arbitration or judicial proceedings.

Such informal negotiations commence upon receipt of written notice from one party to the other (“Notice of Dispute”). Notices sent to WorkScout must be directed to [email protected] and include your name, account email, a detailed statement of the factual dispute, and the specific relief requested.

21

Binding Individual Arbitration & Class Action Waiver

If the parties are unable to resolve a Dispute through informal negotiations within sixty (60) days, the Dispute shall be finally and exclusively resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules.

CLASS ACTION WAIVER: YOU AND WORKSCOUT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Arbitration may be conducted in person, through the submission of documents, by phone, or online. The arbitrator will make a decision in writing, which shall be final and enforceable in any court of competent jurisdiction.

22

These Terms and your use of the Services are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

To the extent any judicial lawsuit or proceeding is permitted under these Terms, you and WorkScout agree to submit to the exclusive personal and subject matter jurisdiction of the state and federal courts located in Tarrant County, Texas.

25

Severability, Waiver & Entire Agreement

Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.
